Terms of Service
These Terms of Service ("Terms") govern your use of tridentair.caand any HVAC services performed by Trident Heating & Air Conditioning Inc. ("Trident", "we", "our", "us"). By using our website or booking service with us, you agree to these Terms.
1. Who We Are
Trident Heating & Air Conditioning Inc. is an Ontario corporation registered with the Technical Standards and Safety Authority of Ontario (TSSA) and licensed to perform residential HVAC work in the KWC Region and surrounding communities.
2. Quotes and Pricing
Quotes provided through this website, by email, or over the phone are estimates based on the information you share with us. Final pricing is confirmed in writing after an in-home assessment. New installations and replacement quotes are provided at no charge. A diagnostic visit fee of $99 applies to repair calls and is fully credited toward any repair you approve.
Quotes remain valid for 30 days from the date issued unless stated otherwise. Equipment availability, fuel and material prices, and applicable taxes may change without notice and are reflected in the final invoice.
3. Booking and Cancellation
You can book service through our website, by phone, or by email. We confirm appointments before dispatching a technician. If you need to cancel or reschedule, please give us as much notice as possible. Cancellations within two (2) hours of a confirmed appointment may be subject to a trip charge equal to the diagnostic fee.
4. Payment
Payment is due on completion of service unless agreed otherwise in writing. We accept e-transfer, credit card, debit and cheque. Financing through approved third-party partners (such as SNAP Financial) is available on qualifying installations and is subject to that partner's separate terms.
5. Workmanship Warranty
Trident provides a written workmanship warranty on installation and repair work. Our workmanship warranty covers defects in our installation, not failure of the equipment itself, and does not cover damage caused by misuse, accident, lack of maintenance, or modifications by others.
6. Manufacturer Warranty
New equipment we install is covered by the manufacturer's warranty (typically 5-12 years on parts depending on the brand and model). We register the warranty on your behalf. Manufacturer warranties are separate from our workmanship warranty and are governed by the manufacturer's terms.
7. Permits, Code Compliance and Inspections
We pull the appropriate municipal permits and TSSA / ESA inspections required for the work we perform. Inspection schedules are set by the inspecting authority and are outside our direct control.
8. Limitation of Liability
To the fullest extent permitted by law, Trident's total liability for any claim arising out of or related to our services or this website shall not exceed the amount you paid us for the specific service giving rise to the claim. Trident is not liable for indirect, incidental, special, consequential or punitive damages, including lost profits or property damage caused by pre-existing conditions, hidden defects, or third-party equipment failure that we did not install.
Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under Ontario law.
9. Indemnification
You agree to indemnify and hold Trident harmless from claims arising from your misuse of our website, your breach of these Terms, or false information you provide that materially affects work we perform.
10. Website Use
This website is provided "as is". We do our best to keep the information accurate, but we do not warrant that every detail (such as financing terms or equipment availability) is current at every moment. Please confirm details with us directly before relying on them for a purchase decision.
You agree not to use the website to send spam, attempt to break our security, or scrape content for commercial purposes without permission.
11. Force Majeure
We are not responsible for delays or failures caused by events outside our reasonable control, including extreme weather, supplier shortages, transportation disruptions, government action or other emergencies.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute will be brought in the courts of Ontario.
13. Changes to These Terms
We may update these Terms as our services or applicable laws change. The current version is always posted on this page with the "Last updated" date at the top.
